GENERAL CONDITIONS OF BUSINESS
(Effective March 1, 2008)
Conditions & General Information: The conditions
below form the basis of any contract between you and PerryGolf
(the Company). When you contact the Company to book your tour,
you appoint them to act as your agent to obtain the requested
services for you. When they have done so, and you have confirmed
the booking and paid the deposit, they will accept responsibility
for providing your vacation from that point onwards. No employee
or representative of the Company has the authority to change
these conditions or information. This Agreement shall be governed
by the substantive laws of the State of Georgia. The parties
irrevocably agree that any judicial proceedings relating to
this agreement will be filed in a court of competent jurisdiction
within Fulton County, Georgia.
Deposit & Final Payment: Schedules of deposit and
final payment vary by program, and are as detailed in the reservations
material of the applicable program.
Cancellation: Cancellation charges vary by
program, and are as detailed in the reservations material of
the applicable program.
Travel Protection Plan (only available to Citizens or Permanent
Residents of the USA or Canada):
PerryGolf recommends that you have luggage, accident and trip
cancellation insurance. PerryGolf is not liable for loss, damage
or theft of luggage or personal belongings, for personal injury,
accident or illness. It is important for your own self-interest
and protection that you make certain you have adequate coverage.
Check with your insurance company or travel agent. You may learn
more about the PerryGolf Travel Protection Plan by visiting
our website at www.perrygolf.com/pages/protection.shtml.
By special arrangement, PerryGolf clients may check the appropriate
box on the reservation form and be enrolled with World
Access Service Corporation. PerryGolf act as an
agent of World Access Service Corporation.
Travel Protection Plan is based on the stated trip value when
protection is taken out. If trip value subsequently decreases,
the protection is based on the lower value, but there is no
refund. If trip value subsequently increases, unless agreed
and stated in writing, there will be no protection provided
for the increased amount.
Car Rental: On independent tours with a rental car,
all drivers must be over 25 years of age, and under 65.
Air Travel: Airline tickets for travel on scheduled
airlines, if they should be issued for you by PerryGolf, are
a separate item out with the travel package, and may carry change
and cancellation penalties as specified by the carrier.
Documentation: For US citizens, a current passport is
required for travel to overseas destinations. A Visa may also
be required for certain countries. Check the requirements in
good time before departure. Citizens of other countries should
check with the appropriate Embassy.
Changes: An administrative fee of $50.00 per change
per person will be charged for changes requested by client or
travel agent after deposit has been received and confirmation
issued. In most cases, changes cannot be made less than 60 days
before travel.
Name Changes: In the event you wish to change the name
of one of the golfers previously confirmed on a trip, the following
per person charges shall apply; more than 60 days before departure
– a charge of $100 plus any applicable nonrefundable deposits
paid to golf clubs which prohibit transfer of deposits, 60 – 21
days before departure a charge of $400 plus any applicable nonrefundable
payments made to golf clubs which prohibit transfer of same;
less than 21 days before departure a charge of $800 plus any
applicable nonrefundable payments made to golf clubs which prohibit
transfer of same.
Golf Handicaps: A number of golf clubs require visitors
to show handicap cards. While this is not particularly common
we strongly recommend you travel with a handicap card,
and accept no responsibility if you do not and are subsequently
denied golf. Certain clubs also place maximum handicap restrictions
on visitors. If your handicap is greater than 24 (men) or 36
(ladies) please notify us in order we can discuss which clubs
may have relevant restrictions. Also, please note that PerryGolf
can accept no responsibility for the playing conditions of any
golf courses, including changes caused by course maintenance
or weather conditions.
Responsibility: PerryGolf, as the tour operator, and
its selling agents act only as agents in securing and booking
the hotel accommodations and other land tour services provided
as others as independent contractors. PerryGolf, its selling
agents or the specified air carriers assume and accept no liability
for injury, loss, damage, accident. delay, changes or inconvenience
caused by: any force majeure - health risks - reason of war
or threat of war – riots - civil strife - terrorist activity
- industrial disputes – acts, omission, neglect, delay
or default of any person engaged in providing any tour services
including transportation and accommodation - technical problems
to transport - closure or congestion of airports or ports -
building work - extended hotel closure - cancellations or changes
of schedules by airlines - interruption or failure of public
utilities outside the control of the hotel and similar events
beyond our control, including storms, tempests and hurricanes.
If any tour service or its reasonable equivalent is not provided
due to events beyond the reasonable control of PerryGolf, the
company will make an appropriate refund of that portion of the
tour price covering the undelivered tour service, but it is
understood that PerryGolf shall have no other or further responsibility
or liability either for the accuracy of any representation or
the non provision of any tour services.
Transport by aircraft, rail, ship or coach will depend on the
conditions of carriage of the relevant carrier. These conditions
of carriage may limit or exclude the carrier’s liability
to you under international law (such as the Warsaw Convention).
The responsibility and liability of the specified air carriers
respecting their performance of air transportation services
are limited by and subject to the conditions of contract in
the passenger ticket, the rules contained in tariffs on file
with U.S. Department of Transportation (available for inspection
on request), and applicable provisions of law and treaty.
PerryGolf is not liable for loss, damage or theft of luggage
or personal belongings, for personal injury, accident or illness
on any vehicle or at any place throughout the tour.
PerryGolf reserves the right to cancel a tour if circumstances
so require. In the event of such, PerryGolf will make a full
refund to travelers of all payments received in respect of the
tour. Such a refund of payments will be the full extent of PerryGolf's
obligation and liability to travelers. This Agreement shall
be governed by the substantive laws of the State of Georgia.

Brochure Accuracy: As far as is known all information
in the promotional and other materials of the Company is accurate
at the time of publication. Changes cannot be made after publication
date, and the Company accept no responsibility for any omissions
or errors. Where they become aware of errors which could materially
affect your travel package, they will take all reasonable steps
to inform you in a timely manner.
Caddies: As a free service to clients, PerryGolf will
request caddies for those who wish them, however they cannot
be guaranteed. They may only be requested for the entire duration
of a trip, and not for individual rounds. If you request caddies,
PerryGolf will forward a request for caddies in advance of your
visit. The golf clubs will make every effort to secure caddies
but they are neither employed by the golf clubs nor by PerryGolf.
Please consult with your Golf Travel Specialist at PerryGolf
regarding the likelihood of accessing a caddie on your selected
courses. In general the demand for caddies at most courses exceeds
the availability. If a caddie is secured for you, the caddie
master or another club official will inform you of the caddie
charge and tipping policy.
